TERMS OF USE – MUNDIPAY

1. Preamble

These Terms of Use (the "Terms") govern access to and use of the MundiPay payment gateway service (the "Service"), operated by MundiPay ("MundiPay", "we", "our", or "us").

MundiPay is a digital payment gateway enabling the acceptance and processing of payments through:

• Bank cards (including Visa),

• Bank transfers via selected partner banks,

• Digital and mobile payments (Orange Money, MTN Mobile Money),

• Payments via cryptocurrencies.

By accessing or using the Service, the User acknowledges having read, understood, and unconditionally accepted these Terms.

2. Definitions

• User: any natural or legal person using the MundiPay Service.

• Merchant: any professional User using MundiPay to accept payments from customers.

• End Customer: any person making a payment through MundiPay.

• Transaction: any payment, transfer, or settlement operation carried out via the Service.

3. Purpose of the Service

MundiPay provides an innovative technological infrastructure designed to securely process digital payments and fund transfers within the digital payment ecosystem.

The Service includes, but is not limited to:

• Collection and processing of payments,

• Redirection to appropriate payment methods,

• Transaction confirmation and traceability,

• Advanced technologies compliant with modern digital payment standards.

4. Access to the Service

Access to the Service may be subject to:

• Creation of a User or Merchant account,

• Identity verification (KYC) and regulatory compliance procedures,

• Compliance with these Terms and any additional contractual documentation.

MundiPay reserves the right to refuse, suspend, or restrict access to the Service in the event of non‑compliance or identified risk.

5. User Obligations

The User agrees to:

• Provide accurate, complete, and up‑to‑date information,

• Use the Service solely for lawful purposes,

• Comply with all applicable laws and regulations, including those related to anti‑money laundering (AML) and counter‑terrorist financing (CTF),

• Refrain from using the Service for fraudulent, illegal, or prohibited activities.

The Merchant remains solely responsible for the nature, legality, and delivery of the goods or services offered to End Customers.

6. Supported Payment Methods

MundiPay supports multiple payment methods, subject to geographic and technical availability:

• Bank cards (Visa and equivalent),

• Bank transfers via partner financial institutions,

• Mobile money payments (Orange Money, MTN Mobile Money),

• Cryptocurrencies accepted by the platform.

MundiPay reserves the right to add, modify, or remove supported payment methods at any time.

7. Security and Technology

MundiPay implements innovative technologies and industry‑standard security measures to protect data and Transactions.

However, the User acknowledges that risks inherent to digital networks and payment technologies cannot be entirely eliminated.

8. Fees and Charges

Use of the Service may be subject to fees and commissions, as detailed in applicable pricing schedules or specific agreements entered into with Merchants.

Fees may vary depending on the payment method and type of Transaction.

9. Liability

MundiPay acts solely as a technical payment service provider.

MundiPay shall not be held liable for:

• Disputes between Merchants and End Customers,

• Service interruptions resulting from events beyond its reasonable control,

• Losses arising from improper or non‑compliant use of the Service.

To the extent permitted by applicable law, MundiPay’s liability shall be limited.

10. Suspension and Termination

MundiPay reserves the right to suspend or terminate access to the Service, without prior notice, in the event of:

• Breach of these Terms,

• Suspicious or fraudulent activity,

• Legal or regulatory obligations.

The User may discontinue use of the Service at any time, subject to the settlement of pending Transactions.

11. Personal Data

MundiPay processes personal data in accordance with its Privacy Policy and applicable data protection laws.

12. Intellectual Property

All elements of the Service, including software, trademarks, logos, and technologies, are protected by intellectual property rights and remain the exclusive property of MundiPay.

13. Amendments to the Terms

MundiPay reserves the right to amend these Terms at any time. Updated Terms become effective upon publication.

14. Governing Law and Jurisdiction

These Terms are governed by the laws applicable in the country of establishment of MundiPay.

Any dispute relating to the interpretation or performance of these Terms shall fall under the jurisdiction of the competent courts.
